This website is owned and operated by The Fingersmith's Garage. These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers users:

an overview of classes and events at The Fingersmith's Garage,
login for registered users to access features, to view course material, book classes and record payments.

By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms. If you disagree with any of these terms, you are prohibited from accessing this site, our apps, facilities and service.

Membership:

Members may be either a student or teacher, to access course materials. Parents/Guardians may be members for wards who are under age.

In order to use our website and/or receive our services, you must be at least 18 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.

Members need to comply with these terms.

Members shall use the application, website and facilities in a professional manner.

Members shall provide accurate information to us and keep it updated.

Members may not provide the application, facilities and services directly or indirectly to third parties.

Members shall not act dishonestly, or unprofressionally.

Members may not use an image that is not to your likeness or a head-shot photo, for your profile.

Members shall not spam others.

Disclaimer

All the materials on the Website and apps are provided “as is”. The Fingersmith's Garage makes no warranties, may it be expressed or implied, therefore negates all other warranties. Furthermore, The Fingersmith's Garage does not make any representations concerning the accuracy or reliability of the use of the materials on its Website or otherwise relating to such materials or any sites linked to this Website.

Revisions and Errata

The materials appearing on The Fingersmith's Garage's Website may include technical, typographical, or photographic errors. The Fingersmith's Garage will not promise that any of the materials in this Website are accurate, complete, or current. The Fingersmith's Garage may change the materials contained on its Website at any time without notice. The Fingersmith's Garage does not make any commitment to update the materials.

Terms for Classroom participation:

When booking a class as a student, you are responsible for reading the full listing before confirming your availability.

When you record a payment for class, exams and other events as they become available, you are entering into a legally binding contract to purchase said item, and you comply with the process.
The prices we charge for using our services are listed in app, as student plan for class fee and exam plan for relevant exams you are applying for. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. Additional information about pricing and is available on the payments page.
The fee you incur for classes are billed on a monthly cycle basis and your history of payments is available to you in app and website.

Safety

Violence: You may not threaten violence against an individual or group of people. We also prohibit the glorification of violence.

Child sexual exploitation: We have zero tolerance for child sexual exploitation at the Fingersmith's Garage.

Abuse/Harassment: You may not engage in the targeted harassment of someone, or incite other people to do so.

This includes wishing or hoping that someone experiences physical harm.

Hateful conduct: You may not promote violence against, threaten, or harass other people on the basis of race, ethnicity, national origin, caste, sexual orientation, gender, gender identity, religious affiliation, age, disability, or serious disease.

Suicide or self-harm: You may not promote or encourage suicide or self-harm.

Sensitive media, including graphic violence and adult content: You may not post media that is excessively gory or share violent or adult content within the class room, or in our zoom or other group sessions, or any other method that is faciliated for the group by Fingersmith's Garage.

Illegal or certain regulated goods or services: You may not use our service for any unlawful purpose or in furtherance of illegal activities. This includes selling, buying, or facilitating transactions in illegal goods or services, as well as certain types of regulated goods or services.

When legally required, or at the discretion of The Fingersmith's Garage will cooperate with law enforcement agencies in any investigation of alleged illegal activity on our site, channels or venue.

Website and App usage:

This website, the apps and its content cannot be used illegally or for any purpose prohibited in these terms of usage, nor can they be used o infringe on the legal rights and interests of other persons or organizations. The Fingersmith's Garage reserves the right to bar any such activity.

You are not allowed to cause or encourage any inaccurate measurements of genuine user engagement with the service, or otherwise manipulate metrics in any manner.

You shall not use any form of device, program, or algorithm, including spiders, robots, deep-links, and page-scrapes, or any identical or similar manual program, to access, obtain, copy or monitor any part of this website or its content. Additionally, you shall not visit, obtain or copy any materials, documents, or information on this website by any method not provided by this website.

You shall not attempt to illegally access, decode, or use any other illegal methods to gain unauthorized access to this website, our apps and its content and services. You shall not trace, reverse lookup, decrypt or decode any customer information on this website, including but not limited to the ID's of users other than yourself.

You shall not violate any of the security mechanisms or authentication measures utilized by or linked to this website. You shall not probe, scan or otherwise test for any network weaknesses of this website, or those linked to it, nor launch any form of attack against it.

You agree not to use any device, software, or program to interfere or attempt to interfere with the regular operation of this website or any transactions performed on this website, or to interfere or attempt to interfere with the use of this website by others. You shall not undertake any actions that store unreasonable or disproportionate amounts of data on this website's infrastructure, system, or network, or on systems or networks that are linked to this website.

Retention of right to change offering

We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

You recognize and agree that by uploading any content (including, but not limited to designs, images, animations, videos, audio files, fonts, logos, illustrations, compositions, artworks, interfaces, text and literary works) through any means to the website, you confirm that you own all the relevant rights or received the appropriate license to upload/transfer/send the content. You agree and consent that the uploaded/transferred content may be publicly displayed at the website.

Right to suspend or cancel user account

We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to automatically-renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment

Indemnification

You agree to indemnify and hold The Fingersmith's Garage harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.

Limitation of liability

To the maximum extent permitted by applicable law, in no event shall The Fingersmith's Garage, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.
To the maximum extent permitted by applicable law, tThe Fingersmith's Garage assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

Right to change and modify Terms

We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these page periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.

Promotional emails and content

You agree to receive from time to time promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages).

If you don't want to receive such promotional materials or notices – please just notify us at any time.

Cancellation & Refund

Fees paid for classes and exams cannot be cancelled or refunded once made.

No refund is offered on unutilized classes, exams, accidental purchases unless required by law to do so.

Cancelled bookings for events, may be refunded in 5-7 days provided the cancellation is made at least 3 days before the event.

Refunds are always to source: A payment via card can only be refunded to the same and not via any other method.

Preference of law and dispute resolution

These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of the Republic of India, without respect to its conflict of laws principles.

Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in Bangalore.

The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.

Shipping & Delivery Policy

For International buyers, orders are shipped and delivered through registered international courier companies and/or International speed post only.

For domestic buyers, orders are shipped through registered domestic courier companies and /or speed post only.

Orders are shipped within or as per the delivery date agreed at the time of order confirmation and delivering of the shipment subject to Courier Company / post office norms.

Fingersmith's Garage is not liable for any delay in delivery by the courier company / postal authorities and only guarantees to hand over the consignment to the courier company or postal authorities within from the date of the order and payment or as per the delivery date agreed at the time of order confirmation.

Delivery of all orders will be to the address provided by the buyer.
